AKRON, Ohio -- A pregnant woman awaiting trial in the death of a toddler she was babysitting is requesting maternity leave from jail.

Tiffani Calise, who is 8-months pregnant, has been in jail since August on $500,000 bail.

The 20-year old has pleaded not guilty in the death of 23-month-old Aaliyah Ali.

Last August, Calise called paramedics claiming the baby was not breathing.

"The babysitter claimed she went to get something out of the closet and left the victim in the bathtub. She heard some noises when she came back the child was limp, she then called 911," said Summit County Sheriff Deputy William Holland.

Deputies say after the baby was taken to Akron Children's Hospital they learned the toddler's injuries were inconsistent with the babysitter's story.

If she's suspected to have killed a child, I'd rather see her having her baby in jail, where she is closely supervised to ensure her baby is safe, until she is either proven guilty (whcih I'm sure would result in her losing her baby) or innocent.

Only if they are awaiting trial Stephanie. Once they've been found guilty, they have no rights, but prior to that, it really is a debatable issue given that constitutionally the presumption should be innocence......

IMO someone who commits murder is always a risk. Why would they even want to take that risk and let them out on bail in the first place?

And no - this woman should not get bail or "maternity leave."

A child died in her care. Probably at her hands. If, it were an accident - she's all fucked up in the head with guilt, who knows what she might do to her own child in grief and anguish (I personally don't believe the bitch will feel any of that).

And it gets iffy too. Bail for repeat drunk drivers.. just because they didn't kill the first 3 times they were drunk driving - we're supposed to continue to allow them to gamble with our lives while on the road.

Its bullshit. They give bail to baby killers all the fucking time, even send them home to their kids. The idea is that they killed someone elses' kid. Its not a fact or even suggested in that act that they are a danger to their own children.

Um its even been known for the courts to send pedophiles home to their own minor kids. Just because the pervert prefers toddlers or hasn't molested his own kids.

LOL emma - not all people up on murder charges are a risk to the community at large - they were probably only a risk to the person they murdered, or at that particular moment in time. Or, if the circumstances are questionable, they may be allowed on bail. I'm not justifying it, just explaining how it works......unfortunately, sometimes the system gets it wrong and someone on bail DOES reoffend!

It's called bail Emma. They do it here too. Some people are not allowed out on bail and some are, depending on the flight risk and the risk to the rest of the community in general.

Yea, it's not a fine in exchange for prison time, which is common here, but not the issue in this case. She can post bail to await trial outside of prison, then when she shows up for trial, they will give it back to her. It's not like she even has an unreasonable bail either--she can borrow against her life insurance or home to post, then pay it back after the trial. She could also use a bail bondsman, but that would be expensive...either way, she's got options.

I'm with Teresa, she can leave jail when she posts bail, just like every other American accused and awaiting trial. She shouldn't get special privileges just b/c she is pregnant, and she is not being denied any rights at the moment.

Um yeah, I'm with Stephanie. Maternity leave is something you take when you have a job. You have your baby and go on maternity leave. 6 weeks, sometimes places offer 8 weeks. It's not paid by most employers but mat leave basically guarantees that you HAVE a job when you're ready to come back (at the end of 6 or 8 weeks). How is it maternity leave from jail? Forget trial, guilty or innocent....it's semantics. She's asking for something that doesn't exist for her regarding jail. She really wants just to be let out of jail so she can spend the last part of her pregnancy at home. Why doesn't she just say THAT? Maternity leave from jail lol That's a good laugh to end my day lol

She isn't at a job, she's in jail bc a child in her care died. Ive never heard of such a thing as maternity leave from jail, like it's her employer. Yes, she may be innocent but if she's granted leave then everyone will think they're entitled or may have the right to the entitlement, even if they're a cold blooded baby killer. No?

Isn't it unconstitutional to assume guilt before being proven to be so? Innocent until PROVEN guilty?

I actually am not sure how I feel about it, but if she is found to be innocent, she will have been done a huge disservice *if* she is innocent. I am leaning towards it being supervised. However, having said that, there are many women who have their children in prison these days while they are still infants, so if that were a possibility while she awaits trial, that probably solves the issue.

I agree with Kati, until she has been PROVEN guilty, I think she should be granted the leave. And since she has a bail amount then she hasn't been proven, they just said it wasn't consistent with her story. So, I think they should grant it, then maybe take the baby and put her back in jail until it is time for trial?

I say no. She is in Jail for a reason. That is no one's problem, but hers.

Um...given just these facts I would have to side with NOT allowing maternity leave. Who knows what she could do to her own child. I wouldn't risk it if I was the judge.
