I agree with Amy. You can't just make the decision to take the children away from him (which is what you were doing when you were so far away and decided not to go home). That isn't your right. All he has done is exactly what you did. To be honest, neither of you are playing fair. You both have rights, and even more to the point, the children have a right to a relationship with both parents.

If I were you, I'd get a good lawyer. I don't know the laws in Brazil either, but if they are anything like everywhere else in the world, you are likely to end up with joint custody, but if you don't get a lawyer, he will likely win his full custody and you will get some visitation.

Here's my opinion, you say he kidnapped his kids, what did you think you were doing by not returning home with your kids? You essentially were doing the same thing to him but now that he's turned the tables on you it's not fair? I don't know how the laws work in Brazil but my best advice for you in the future is to go through the court system and get your kids legally, good luck.
