Child Support

I have been waiting for my child support to kick in, My daughter was born in October 2008, the jerk made us get DNA tests, so that was done and over with in Early Jan. I am just curious as to when I might expect money to start coming in. Any one out there going thru similar? Or have any suggestions as to how long it could take? I am in NB Canada. I am also curious on how it is I am going to be paid for the back money he owes me as well (Oct, Nov, Dec, and Jan, quickly coming up on Feb as well) I am a first time mom so its all new to me.

Please have your lawyer to contact his CO (his captain) and let them know what is going on so that they can start having it coming out of his checks every two weeks. The military is pretty strict on the men paying their support and taking care of their families.

Jasmine, in Ontario we have a Family Responsibility Office that enforces childsupport by garnishing wages, suspending driver license and so on.  Here is a link for you that I've found on Google for you.  I hope this helps.



I used to have a file with FRO, but my ex begged me to withdraw and promissed that he will pay on time.  He was late with his payments for 3 months and this month he just simply stopped, so I am going to re-file to have his wages garnished.  This way I am still not guarantied to get the support , but I have more hopes to get the payments.

you can ask that the payments get taken directly from his pay into your bank account

Hey im a 20 yr old mom in australia im claiming child support there was no trouble getting it as the father of my son has two other daughters to 2 different woman and only pays for 1 just like you im still trying to understand it all my son was bor in november 2008 his dad admits he is his and so far i have only recieved a big $19.40 out of the $363.30 a month he owes me.

I wouldn't hold my breath on waiting for the payments. My son is 2 years old finally got a court order last year in April 2008. He paid for one month and that was it. I have not recieved anything since June of last year. I take that back I checked today and got $7.00 WOW. I had to go back up to the courts and file a review for non payment of child support so he had a court date yesterday and that was the only reason I got the $7.00 today. He has two other cases by two other females and he paid the court a whooping total of $25.00 yesterday and they divided that into his three cases. I am currently owed $3,800 including back child support. If they do not work and take it out the paycheck or they voluntarily send in payments you won't get anything and the states doesn't do much of anything to pursue it, they just let it add up.

Yea my sister didnt get her child support money till about a year ago and my nephew is now 3 so yea...haha it really sux

Oh I am also aware that in Canada at least that the support payments are determied on the fixed income of the parent in question and also the number of children, but without the knowing of how much he makes a year. I can't even determine how much I am supposed to be getting!!!...this is the fusturating part, then again, if I knew and wasn't getting it I think that I would be torturing myself with the $$$$ floating on how much he owes up to this point and where that money could be going to make our life easier.  I think I just feel better knowing that I am not the only one going thru this foolishness and not getting any results.

Alright for clairfication purposes, because I am getting a battery of different answers lol...(however I am greatful for each and every reply and thank you ladies) .



I filed for Child support before she was born, She was born on the 15th of Oct, I called my lawyer the 16th, did the DNA Test the 16th of Dec Got results Jan 8th 2009, Faxed Birth Cert on the 5th of Feb for Coverage on his military health care. Still no change or cash.



Her Father is in the airforce, we are in contact, My lawyer has filed for support to be backpayed from the 15th of Oct.  The payments will come thru the courts as they will be garnishing his wages.



 



My curiosity was a time frame on when I can expect the payments to start coming in........

I have applied for child support and haven't herd anything yet. I have to get a DNA test because the father is not on the birth certificate. I think that the father is responsible for paying the back child support. I'm not sure if there is a payment plan for the father or if he has to write a check. If I find out anything I will let you know.

hi my son is 9 months and i have only gotten 3months worth of child support cuase my ass of an ex figured out that if he gets jobs with out a fixed income(like seasonal jobs) then he doesn't have to pay

I dont know that we all have the same laws but let me tell you something that I did. As soon as my daughter was born I went to Domestic Relations (FYI here in PA and I am sure in the rest of the US we have Domestic Relations and you dont need to have a lawyer in most cases and they inforce whatever the court order states) that was May 1999. My ex didnt go to the hearing until October because thats when it was scheduled for and we are in different states..me in PA and he in NJ. When I didnt hear anything about the money I called my case worker who sent NJ a letter and then never heard anything. I go SOOO annoyed that I started calling NJ and writing my butt off and I was told the court order got lost!! It took me from 2 months just to find that out. So I wrote to my congressman and then to a few NJ congress people and you know who ACTUALLY helped me? A rep from the NJ Congress woman!! What I am saying is dont take I DONT KNOW for an answer!! it took me a year to get the child support! And if your ex looses his job..not your problem whatever his excuse is..notify your case worker or lawyer! Believe me I have been going through this almost 10 years now! Much luck!!

I don't know how it work in Canada but in California with my son's dad in Ohio it took a good over 6 months after I filed the paperwork. I had the DNA done like he wanted cause he is in the US Airforce, but after 3 months of not getting anything I filed with the court and it still took a year before I saw any money. Of course the delay was cause he didn't agree on the amount the court said and then his lawyer wasn't informed of the court date but it does take a long time. My suggestion is to find out how to get the court to place and enforce the order of how much he needs to give you.

Well my daughters dad and I broke up in 07 - and he hasnt paid a thing - but IRD are soon to be on to him so he has to pay some money as really hard doing it with little money I get



Give it time :) Just give them a call when you like and see what the hold up is

If he is in the military, then go to his commanding officer Im not sure of the title, but they will get it strightened out for you. Dont stop calling and if you have a lawyer, then get on them too, the squeeky wheel gets the oil.

hi jasmine , im not sure how NB CANAda works in the child support , but here in CT it took me a atleast a good 4 months to start recieving my payments , it might start in a lump some or few at a time if its coming out of his paycheck , just wait, also it took another 5 months for it to be a timly thing , ,the judge is the one that determine what and how much should be be paying on a weekly basis, try a hot line number thats connected to child support , hope this might help alil , i am proud of you for going after him , i waited 6 years before i started , i gave him the benfit of doubt , good luck and try not to rely on it , as much

If he is in the military call his commander and tell them you are not receiving anything. They will make it happen within a month . You must be aggressive to talk to the commander though because the secretaries will give you the run around. I know ; I was a secretary in the Army for 11 years and i know how it works. But if you talk to the commander he/she has about 1 week to make it happen.

let me clear this up.....Fuck em'... my daughter is 14 months she was born november of '07 i filed as soon as my newly deflated ass could. lol and hes is COURT ORDERED to pay $683 a month. he works for the post office makes good money... he hasnt payed a dime. but i live in missouri. so. but what i do all the time and it seemed to really kick in is to go and talk to your case worker and push the fact. and if they give you the cold shoulder so straight to the prosicuting attorney and they will handle it from there. good luck sweety

i am starting to go through the same things.. also in NB.. my babies dad lives in Calgary... i just got a lawyer last week.. as he has not paid anything ( well 400 over 3 months ) and i had to pay all my own medical bills and such.. so im also not sure.. if you have courts already involved did you have a lawyer?? can they not tell you?? i

You are a very lucky lady that he is in the military. It is easiest with them but it might take until March before you get any money. They automatically deduct it from his pay well they did for my ex when he was deployed. Even though u are just talking to a lawyer there is usually still an department/agency that collects the money and hands it over to you.

There is no agency we both have a lawyer, and he's in the Military so he has a fixed income which I am privy to each year for tax purposes. So I know that I will be getting a fixed amount...someday...

Well, I did not get support; he claimed financial hardship and was self employed. But I did withhold it from employee’s checks for years, and they have a set amount based on how much they owe that they try to collect each month. The employer deducts the amount biased on his income and pay dates. If they request 100 a month and he is paid 2x a month they would take 50 per pay check and send it to the agency collecting. How they distribute the monies I have no clue. It also depends on if he makes enough to have anything withheld, each state has different guidelines as to the total earned and what comes first with garnishments. You may be behind the state for taxes or something. Check with the agency you are working with for a guideline of dates they distribute payments, direct deposits go first and are faster.
