I lost my custody battle and my daughter was taken from me. It started when she was 2 years old and lasted 5 years. The father went to court with his friend who was a lawyer and created lies to paint a bad picture of me and got an ex part order giving him full custody. I didn't have a lawyer and didn't know I had 48 hours to get her back. After getting lawyers and me and my family running out of money it ended after 5 years of fighting. I lost. He moved away to another state and wouldn't let me speak or see her. He ended up coming back and I made contact to her directly avoiding him at her school. We have been spending time together and we're already so close. She has just told me he hits her. I don't know my rights if I have no custody. She told me not to tell him. She's afraid of him. This man had a long criminal record that was sealed during our custody battle to make himself look clean. He had rape on his record. That is just 1 out of 3 that he was actually charged for. He is a horrible person. She was wrongfully taken from me. She has been put with the wrong parent. She doesn't deserve to be hit and abused. She is now 15.

Thank you Shawn Lively for your response. All Information is helpful. I am a nursing student so money for a lawyer is tough right now. Thank you Shawn

see a family attorney. If he has court orders indicating contact must be maintained, and he did not do so, he can be prosecuted for contempt of court.

And you can always re-petition custody. However, I do have to say that, if you are in the US, and she is 15, she will most likely be given choice of residence. Just so you're aware that her choice will be taken into consideration.

But, you do have to go to court.
