Changing my sons name from his fathers to mine and going full costody

I was engaged to my sons father when he was born, so I put his fathers last name down. Now that we are no longer together, im trying to change it into mine as it will make it easier. But in QLD you need both to sign off, just don't know how its going to go if his dads making it difficult? Also going through mediation then court for full custody, as Rydar's father has never really taken a part in caring for him, also has mental health issues...has anyone gone through this and how did it all work out?

Well, not trying to judge you, but a child needs his father. Mental health issues or not, divorced or not, whether you hate his guts or not, your child needs him. I don't think you should change his last name, at all. You can't change the fact that it is his son. Perhaps you should try to persuade your ex to take a more active part in your child's life.
Of course, if these mental health issues are dangerous, someone should supervise him when he is spending time with your son.
My husband has two boys from two former marriages and trust me, it was always easy to tell they were sad when he was not on good terms with their mums-even if the eldest never knew what it was like for his parents to be together since he's lived with mom since the beginning. The best thing you can do is be friends with your ex. Perhaps not right now, if you've divorced recently and there's still all the emotional turmoil and lots of hurt and pain present. But, one day-the sooner, the better for your kid.
Changing the boy's name might be easier for you, but might not be the best and the easiest thing for your son.
Please, don't take offense - I apologize in advance if there are some extreme circumstances going on that you didn't mention. :)
