I would bring all of your irs papers with you and ask the judge if she can add it into the order. if she cant, she may at least explain to your ex that he cant

I would just tel ask the judge what they think should happen when it comes to claiming the children on taxes and explain the situation, both in custody court and support court if their different (mine are). sometimes the judge will add it into an order, but it comes down to who has residency of the kids. were u able to claim the children and receive a refund?

court can only help so much, since they really cant do anything about it. if the kids lived with you for at least 6 months or more out of the year than you can claim them. it seems he may have lived with them that long too though, its a close call. it will probably come down to has the highest agi gets to claim them. you can mail in your return claimimg them and wait for audit papers and then send in everything they ask for and bope for the best. as long as they continue living with you next year shouldnt be a problem, but whoever xlaims them first gets theirs accepted first and its not fair. my ex has done this to me twice now. good luck

Yes...bring it up in court! You can also report it to the IRS and provide proof that the children were living with you (school records, statements from family or neighbors, etc). Did he give you any of the money? Either way if they were living with you he should not have done that without your permission.

Have you been to court yet? Usually this is something that is discussed during mediation who gets to claim the kids. If you are just waiting for a court date then yes you should absolutely bring it up and try to get some of that money back from him.
