Father of baby not at birth because of work

I'm concerned that my fiancee won't be able to attend the birth of our child because he just started his new job not long ago and already informed his boss he may need off Oct 22 (when our son is due). But babies don't always arrive on the exact due date. Don't get me wrong he wants to be there. But I'm curious if anyone out there has or has had the same concern and it actually happened because some bosses are not that well understanding. With my first child his dad was there but was threatened by his boss that he'll be fired. Even when he used his whole 5 day vacation. He worked at a car wash and his boss depended on him so much because they made a lot tips and didn't care if he was going to be a daddy for the first time or on vacation he wanted him working. Anyway I told my fiancee I didn't want him jeopardizing his job if our son doesn't arrive on time, could be a week late, days early etc. I care for him being there but my job doesn't pay for leave and he'll be the only one with the income for the next 12 weeks til I return to work, plus paying spousal support since his wife refuses to sign papers for divorce which has been going on for 5 months now.

he should get fmla leave, at least in ny i know that you can't be fired or anything for family medical emergencis and birth of a child falls into that.
