Last time I checked the answer to that was no in this state. I don't know the laws in your individual location but most places it's not likely without written permission.

If you two are no longer together, then neither one of you are allowed to take her out of the country without a written letter of consent from the other parent, with specific dates of departure, and re-entry, and locations of travel (I think this also applies if you are together). If you are truly concerned something may happen, you can put her on a securities list. When he tries to board a plane, or exit the country with her, they will automatically pull her name up on the list (he has to show her birth certificate and passport), and if he has no letter of permission, the police will be called.

if there are no passports in hand - and they have to be requested ---- both parents have to sign the papers in order to get them. A simple birth certificate is not acceptable - my husbands ex had to get his permission to request theirs since the office had the birth certificates, and then requested documentation that she had complete custody - which she didn't - it's all joint. So they made her get his permission and he had to sign official documents for them as well.

Depends on what your custody papers say. And if you have none, then yes he can. And yes you can.
