I'm from New Zealand so it might be different here. But if the father is on the birth certificate, he has a legal obligation to pay child support. Whether thats through private arrangement (which has to be declared) or the Tax department take it from his wages. If he was successful in gaining guardianship and visitation rights and he is using these then he is actively acting as a parent and should be contributing to his son living expenses. Good luck in court.

He got guardianship? If this is the case and you are equally involved with the custody then he doesn't pay child support but if he only has visitation rights and is not a full custody parent of you son then he does and the courts shouldnt deny this. if they have and that is the cirucumstances you should be able to appeal to the court and get it reconsidered. If he's working he should be paying some kind of child support. Good luck.

no be lucky that his father even wants anything to do with him my son's father decided that he would rather be a crack head, he's been gone for 4yrs now. My best suggestion is to either tell him he has to follow the court papers or none of the stipulations in the documents apply or take it back to court! If there isn't anything about child support in the papers then you should file for it! I hope you get it figured out and all goes well!! Take care

File for childsupport especially if it wasn't agreed upon out of court. They will garnish his wages if it comes down to it. If your child lives with you then you are entitled to it.

How did he get away with not paying any child support. Was it not ordered? Was it even heard? he filed for visits, if they didnt hear chidsupport you should file for it.

Visitation and child support are usually 2 separate matters as far as the court is concerned. Most states I believe have a legal aid department set up to help with filing for child support. Hope that helps.

You may have to go to family court and get an order for child support ..they will garnish his wages if they have to. I have not had to deal with this so i don't know what the costs are but if you cannot come to an agreement out of court this is the only answer.
