Hi moms,

After 8 years I finally started receiving child support.
Well that only lasted about 4 months, now he is supposedly unemployed due to an injury and
I received papers in the mail to go back to court.
I don't understand why I have to go back to court.
As far as I understood if this was to happen, the checks would stop and as soon as he was back on his feet then back pay and once he is caught up back to normal.
Can someone please advice.

He's probably requesting a review of the child support amount. If he doesn't get the amount reviewed, he will still owe the amount ordered, whether he is working or not. By getting it reviewed and reduced, his debt to you won't be as large.

Well, you can't get blood out of a stone. If he has no income he can't pay. I wouldn't say it is a break. He's not benefiting from it if he doesn't have a job.

Well of course he has every right to see him. Originally the mediator had said I was getting $600+ but my son would have to go with him during summer, every other weekend and sometimes during the week. Which I was not ok with because my son doesn't even know him much less want to see him. Im not handing over my son just like that just to get 600+. So the mediator said we can work it out on our own and have it in writing with the court or let the judge decide. So we came to a deal if he was to follow all of the visitations it would go down to $300+, so I cut him a deal of 250 and don't bother my son. He happily agreed.

Been getting child support for 4 months +, now I have a notice he is unemployed and we need to adjust payment now. As far as I understood last time we where there if that was to happen yes checks would stop coming but back pay would just start from that point on. But I guess that is not the case, I think basically if he has no income there is no child support for him to have to pay. Another break for a dbd.

I'm confused. You have court ordered visitation and he didn't follow it? Or you would not agree with it?

He was paying way less than what he originally was supposed to pay. When they added his check, child support would have been $600+. I would not agree to visitation so I dealt with less than what he would have owed if he was to follow every single visitation as judge would have ordered. So his payments where already low only $250. He happily took it and now this. He is just wasting my time & I do work.

So what should I do? Is he trying to freeze it so there is no back pay on what he has already agreed to? That wont agree to. It took 8 years to get his sorry butt, I let 4 months back pay go to start fresh and now he is doing this. What are my options.
