I'm just starting to think about filing for sole custody of my son. His father kicked us out when my son was just 3 months old. He lives over 3000 miles away and has shown no interest at all in my son, that is, until he received the child support paperwork. I believe that he is just trying to scare me away from going after child support for my son by threatening to get custody. I am a little worried, I'll admit that, but I want to know what the likelyhood of him getting any sort of custody would be?! I mean, how could he get any when he hasn't shown any kind of love to my son, or hasn't even seen my son in over 9 months?! Thanks for any advice that you may have.

I went to talk to a lawyer when I was thinking about going after child support and custody and was told that the likeliness of getting sole custody these days is next to zero unless you can prove he is a danger to the child (drugs, alcohol, abusive, etc.). My ex has only seen his son about 4 times in the last 3 years, and I did not want to take the risk of having the possibiltiy of my son being at his house every second weekend, therefore I decided not to go after him for support or custody. makes things tough but I feel safer this way.

Hi Rebecca;



I am having the same problem right now but I have hired an attorney... Must likely he will get visitation rights but I recomend to talk to an attorney , he should be able to advise you on this issue... Most attorney offer appoitnment free of charge for the first hour...
