You have a lawyer correct? If so have your lawyer request what should be public records about your ex being in and out of jail. You may even be able to request these arrest records yourself. In certain states (I know Florida has this) you can actually look up online when the last time your ex was arrested. Don't stress over this. Sounds like you have the upper hand here when it comes to what is best for your kids.

I don't think you have nothing to worry about since he has been in and out of jail. I don't think the judge will favor that he take full custody of the children. Just make sure you let your lawyer know all this.

I don't think you have anything to worry about. I'm with every one else one this take him to court first and make sure you have everything documented when you called him how long it took for him to call back and his record make sure you point that out especially if you have a clean record and you been the one caring for the kids. GOOD LUCK!!!

ok well i know in florida, the kids always stay with the mother unless the mother is endangering her children one way or another.if he is in and out of jail and doing this and doing that and your not, then you dont have anything to worry about.i'm not sure what state your in but just sit down with your lawyer and find out the different laws pertaining to your situation and go into detail with your lawyer about what you want out of this and ask him how he can help you get what you want.

one step at a time, just make sure your lawyer knows everything about his criminal past. I've been there but just stay strong and have faith that your lawyer will represent you accordingly. and make sure you know what you want out of it as well.
