Parents or Courts- Who should decide?

Eryn - posted on 12/29/2010 ( 1 mom has responded )

My Abusive Ex has no contact and hasnt had contact for about 2 years. It was my decision as well as the courts for our safety that I have sole custody and he has no contact after a serious series of events. My issue is that the restraining order is up and he could potentially take me back to court to gain visitation with my son. My son was only 18 months old when this occured and has no idea who he is and I would love it to stay that way. Do you feel that if this was to occur that it should be my decision or the courts for visits.

unfortunately if he does decide to take you back to court the decision is in their hands. hopefullly they make the right one. i feel that abusive people shouldn't be aloud visitation with children. but i've heard that often times they only remove the victim from the situation. if he never touched the baby, the courts may award him visitation. if this happens there's nothing you can do except hope and pray he never hits the child, and wait until son is old enough in the court's eye to say who he wants to live with.

when i was 14 i went through a similar situation with my father. thankfully the court let my mom have custody of me but i still had to visit him. it wasnt until my father crossed the line with me that they finally said i didn't have to go there anymore.

good luck and stay strong, i wish you and your son the best!
