Hi, I need some advice! I have 2 children my eldest son is not my partner but his father has no interest in seeing him and hasn't for years, me and my parter were talking the other night about him adopting my son but I know my ex don't be easy about it all how do I go about it all and can my boyfriend adopt my son? Please help

Your boyfriend cannot adopt your son. You must be married for him to be able to adopt. The bio father must have his rights terminated in order for your spouse to adopt. Each state has their own set of rules for how a bio father's rights can be terminated. Some states have abandonment terms and other states require the bio father to sign legal documents or appear in court. You would need to find out what your state requires. For your spouse to adopt you would need an adoption agency or adoption lawyer to do a home study and the number of post placement reports that your state requires.

a boyfriend may not be an easy adoption. if it was a step-father and the biological father had been absent (monetarily as well), it would be easier to claim abandonment.
