Hello everyone, Sometime in July The father of my two children & I went to court for custody. The judge gave the father the rights to take our children to school & all, because right now I have no car. But the judge gave us joint custody since the children have been in school it has been awful I have not seen my children in almost 3 weeks, I do call them & talk to them I have asked the father what is going on he never gives me a reason. His girlfriend thinks she is in charge of everything so she told me that next weekend is my weekend & I can have 3 weekends in a row with them. Well I talk to my lawyer he said he will file a motion. The father of our children thinks he can do whatever he wants but the actual order has not been filed yet. Its just heart breaking to me.. Has anyone gone through this stuff before??? Thank you for reading!

Hi Dove, Like I told Shawnn the judge told us what the schedule would be like right then & there. But he said it would take up to 30 days until the order is placed which it has been way over 30 days :( but I told my lawyer about it he said they will draft the motion next week we will try to get it heard as soon as possible. But without the actual order filed they cant file for contempt so the first step is to force entry of the order which is what the first motion will be. I am not sure if this will help or not I guess I have to be patient which is very hard :(

Hi Shawnn, The judge told us how they schedule would be right then & there. But he told us the order schedule would take up to 30 days which its been way passed 30 days this was in July when we went. I guess we all have to be patient! :(

Ditto Shawnn. If you don't have parenting time specified in your court order you are just going to have to try and be patient (as hard as I know that is) until the court order gets modified. Once it has everything spelled out then you will be able to hold him in contempt if he doesn't follow the order allowing you YOUR time w/ the kids.

If you were granted joint custody, there should have been a schedule laid out at the time. If one was not set, your attorney will need to request a review, and a schedule for custody exchanges.
