Custody Battle....I AM SO STRESSED!

I am currently in the middle of a custody battle with my 3 year old sons father. We are young parents 23 and 24 and even though I grew up and became more responisble he was never made to because he had and still has his parents who support him with not only a house and car but also pay for everything for him so he has not had to work for the last 3 years so he could focus on his school. I on the other hand have worked full time and gone to school for the last 3 years. But now that we are broken up he is trying to fight me for full or joint custody. Even though up until now we have been doing every other weekend and then he gets him one or 2 days a week which is just like custodial custody but he will not agree to anything less than joint custody and me saying that our son lives in his house a majority of the time, even though that is not true. I have my own apartment where he has his own room. please let me know what my chances are that his father could get joint custody?!

Unless he is a danger to your child, many courts (though certainly not all) like to go with joint custody as it is better (generally speaking) for a child to have equal access to and an equal relationship with both of his/her parents.

It is possible for your ex to get joint custody. It's also possible for him to get just weekend custody but this really depends on the situation, and the judge, and a whole list of other factor.

I would really go talk to a lawyer about this and figure out all your options. It's unlikely he can get full custody of your child. You can always show a lawyer/judge all the things you are doing and can provide and that your ex doesn't have his own place or job.

I would really talk to a lawyer about all this.
